TRANSCRIPT: Judge Revokes GPS Monitor, Sends Luke Wenke Back to Jail

This federal court transcript documents a December 14, 2023 status conference in USA v. Luke Wenke, where U.S. District Judge John L. Sinatra Jr. ordered Wenke back into custody only days after he had been released under GPS monitoring.

During the lengthy hearing, the court reviewed Wenke’s conduct following his release, including social media posts provided to the court and concerns raised by U.S. Probation. The parties also discussed efforts to obtain psychiatric treatment and an evaluation for Wenke, his statements concerning medication, and whether available community-based services could adequately address the situation.

Judge Sinatra repeatedly emphasized that the central issue was public safety. Although Wenke’s defense argued that detention would not solve the underlying mental health and treatment problems, the judge ultimately concluded that he could no longer find, by clear and convincing evidence, that Wenke posed no threat to public safety or anyone in the community.

Wenke was therefore remanded into custody pending sentencing. When his attorney suggested continued GPS monitoring and other release conditions, Judge Sinatra responded that the court had already tried those measures and expressed concern that Wenke was not taking the situation seriously.

The transcript provides a detailed, word-for-word account of the hearing that resulted in Wenke being remanded into custody at the Orleans County Jail in Albion.
