The following court records document Luke Wenke’s first of two appeals stemming from his federal cyberstalking case and subsequent alleged supervised-release violations.
The appeal followed the court’s determination that Wenke violated the conditions of his supervised release by indirectly contacting his cyberstalking victim via an email to the victim’s business partner. Wenke had been ordered to have no contact with the victim, either directly or through third parties.
Federal authorities accused Wenke of sending the email just weeks after his release from federal prison. Wenke maintained his innocence, but the judge determined that he was responsible for the email and intended for its contents to reach his victim.
Prosecutors asked the judge to send Luke Wenke back to prison for a year, arguing that he had clearly not learned his lesson during the year he had just finished serving. Instead, however, Wenke was sentenced to time served and ordered to undergo additional outpatient mental health treatment.
